Terms of Service
All sales are final. No refunds, returns, credits, or chargebacks will be issued under any circumstance — including but not limited to dissatisfaction with the Service, change of intent, partial usage, accidental purchase, or cancellation before the end of a billing period. By signing up for a paid plan you irrevocably waive any right to a refund. If this policy is not acceptable to you, do not sign up.
These Terms of Service (“Terms”) govern your access to and use of the TerawattIQ platform, including the website at terawattiq.com and the application at app.terawattiq.com (collectively, the “Service”) operated by TerawattIQ (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Account and acceptable use
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree not to: (a) reverse-engineer the Service; (b) use the Service to violate law or third-party rights; (c) use automated scraping in a way that materially exceeds the rate limits of your plan; or (d) attempt to access another customer's data.
2. Subscription, billing, and no-refunds policy
Paid plans are billed in advance via the payment method you provide at checkout. The Personal plan is billed annually at $249/month equivalent ($2,988 paid up front). The Enterprise plan is billed annually under a written order form arranged with sales.
All payments are non-refundable. No refunds, credits, or pro-rated reimbursements will be provided for unused time, voluntary cancellation, downgrade, change of intent, dissatisfaction with the Service, or for any other reason. Initiating a chargeback, dispute, or reversal with your card issuer or bank constitutes material breach of these Terms and we may, in addition to recovering the disputed amount, immediately suspend or terminate your access without further notice. You can cancel renewal at any time; cancellation prevents the next billing cycle but does not refund the current one.
3. Data ownership and provenance
You retain all rights in data you upload (the “Customer Data”). We retain rights in the public datasets we ingest and the derived analytics surfaced through the Service. The Powered Land Score and underlying scoring methodology are confidential TerawattIQ intellectual property; you may use scores in your internal materials and external transactions but not republish them in bulk.
4. Service availability
We target 99.5% read availability on the Personal plan, and 99.9% with a written SLA on Enterprise. Availability targets exclude scheduled maintenance and force-majeure events.
5. Termination
We may suspend or terminate accounts for non-payment after 7 days of failed payment, for material breach of these Terms, or for use that endangers the Service or other customers. On termination, your data is retained read-only for 30 days, then archived; export is available throughout that window.
6. Disclaimer
The Service is provided “as is”. Output of the Powered Land Score and other analytics is provided as decision support, not as a substitute for engineering, legal, or financial judgment. Site investments should always be independently validated.
7. Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages.
8. Changes
We may update these Terms by posting a new version with a new “Last updated” date and notifying active customers via email at least 14 days before the change takes effect.
